FERPA Notice

The Family and Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of students’ education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education.

Because LiveWhale products allow content managers to create forms to collect information from website visitors, it is technically possible for content managers to collect information that is considered confidential under FERPA. 

White Whale maintains reasonable administrative, physical and technical standards to ensure that no unauthorized persons are able to access information gathered via LiveWhale. All data on LiveWhale Calendar instances is logically segregated on a per-client basis, for example, and all user accounts have passwords and brute-force login protection. 

As stated in our Terms of Service, all content created and managed with LiveWhale is the property and responsibility of LiveWhale customers, who are solely responsible for ensuring that their information collection practices are compliant with all applicable federal, state, and local regulations.
